Understanding Australian Law

Hello, my name is Nigel and this is my law blog. The law can be a complicated and complex thing to try and understand, especially if you are not a trained lawyer. I am not a legal professional but I take a deep interest in the law. It all started when my uncle was involved in a lengthy court case and I decided to find out a little bit more about it. I started reading a legal book and didn't stop. I am fascinated by the law so I decided to start a blog so I could share my passion with others.

When You Should Call a Family Lawyer

When you think of calling a lawyer, you might think about defending yourself after an arrest or dealing with a neighbour dispute. However, there are many different areas of law, including family law. Here are some situations where it is in your best interest to call a family lawyer.

Divorce or Separation

The first situation where you might want a family lawyer is if you are getting divorced or separated from your spouse. Even if you are now just considering filing for a divorce, you should still find a good attorney to help you with your case. Divorce has many different legal issues involved, from property ownership to child custody and spousal support. Whether you are the one filing or your spouse has asked for a divorce, you should begin finding a lawyer right away.

Adoption

It is also a good idea to consult an attorney if you are planning on adopting a child. This includes whether you are just starting the adoption process through a local or international agency, or if you have a stepchild whose birth parent is giving up their rights and allowing you to adopt them. An attorney will look at the adoption contract, investigate the agency to be sure they are trustworthy, and ensure all financial transactions go through without any problems. You should also get a lawyer if you are on the opposite end of this and giving up a child for adoption.

Prenup Agreement

If you are engaged to be married and have decided to get a prenup drawn up before marriage, you will need a family lawyer to help you with the agreement. The lawyer can help you navigate the agreement, including helping you decide what you want included and to make sure everything is legal. The prenup is not just for your own financial protection but for that of your future spouse as well, so it can be mutually beneficial.

Social Services

Any time you are contacted by social services in regards to your children, whether you think it has any merit to it or not, you should consult an attorney. It is possible that there was some miscommunication that led to someone calling social services about the welfare of your children, but you should still treat it just as seriously as any other family dispute. A lawyer can look into it and help communicate with social services, helping guide you through the investigation and ensure nothing happens with custody of your children.
